Welcome to Luxenoir. These Terms & Conditions (“Terms”) govern your access to and use of luxenoir.com (the “Website”) and your purchase of products offered by Luxenoir (“Luxenoir”, “we”, “us” or “our”). By accessing the Website, creating an account, placing an order, or making a payment, you agree to be bound by these Terms together with our Privacy Policy, Shipping & Delivery Policy, Cancellation Policy, Returns, Replacement & Refund Policy, and any other policies displayed on the Website.

1.1 Eligibility and Account Information

You must be legally capable of entering into a binding contract under applicable law to place an order. You are responsible for ensuring that the name, email address, phone number, billing address, shipping address and other information supplied to Luxenoir are accurate, complete and current. You are responsible for maintaining the confidentiality of any account credentials and for activity carried out through your account.

1.2 Products and Product Information

We aim to display product descriptions, materials, dimensions, colours, finishes, images and other information as accurately as reasonably possible. However, colours and appearance may vary slightly due to photography, lighting, screen settings, manufacturing batches, natural material variations or device display differences. Such minor variations do not by themselves constitute a defect.

Product availability is subject to stock. We may update, discontinue or limit quantities of any product without prior notice. If an item becomes unavailable after you have paid, we will contact you and provide an appropriate refund for the unavailable item.

1.3 Pricing, Taxes and Charges

All prices displayed on the Website are in Indian Rupees (INR) unless expressly stated otherwise. The final amount payable, including applicable taxes, shipping/delivery charges or other disclosed charges, will be shown before you complete payment. In the event of a genuine pricing, typographical or system error, we may cancel the affected order before dispatch and refund the amount paid.

1.4 Order Placement and Acceptance

An order is placed when you complete checkout and receive an order confirmation from Luxenoir. Your order may be subject to payment authorization, fraud/risk checks, stock verification and other reasonable verification. We reserve the right to decline or cancel an order before dispatch where necessary due to payment failure, suspected fraud, legal/regulatory restrictions, inventory errors, pricing errors, or an inability to service the delivery location. If we cancel an order after receiving payment, the applicable amount will be refunded to the original payment method.

1.5 No Customer-Initiated Cancellation After Order Placement

Because order processing begins promptly after checkout, customer-initiated cancellation or modification is not available once an order has been successfully placed/confirmed. Please review the product, variant, quantity, price, delivery address and contact details carefully before completing payment.

This restriction applies to change-of-mind cancellations and order modifications. It does not limit any remedy that may be available under our Returns, Replacement & Refund Policy or applicable law where the product is materially damaged, defective, incorrect, counterfeit, not delivered, or otherwise fails to match the order in a manner for which a remedy is legally required.

1.6 Payments

Online payments are processed through Razorpay and/or other payment methods displayed at checkout. By selecting a payment method, you agree to the applicable terms of the payment provider. Luxenoir does not intentionally store complete card numbers, CVV, UPI PINs, internet-banking passwords or other sensitive payment credentials. Payment processing may be subject to additional verification or authorization by your bank, card network, UPI app or payment service provider.

1.7 Shipping and Delivery

Shipping and delivery are governed by our Shipping & Delivery Policy. Delivery dates are estimates unless expressly guaranteed in writing. Delays may occur due to courier operations, weather, public holidays, regulatory checks, remote-area limitations, force majeure events or other circumstances beyond our reasonable control.

1.8 Intellectual Property

The Website, Luxenoir name and branding, logos, product photography, graphics, text, page layouts, design elements, software and other content owned by or licensed to Luxenoir are protected by applicable intellectual-property laws. You may access and use the Website only for personal, non-commercial shopping purposes. No content may be copied, reproduced, republished, distributed, modified, scraped or commercially exploited without prior written permission, except where permitted by law.

1.9 Prohibited Use

You must not misuse the Website, attempt unauthorized access, introduce malicious code, interfere with Website operation, use automated means to scrape or extract data, impersonate another person, submit fraudulent transactions, infringe intellectual property, or use the Website for unlawful purposes.

1.10 Third-Party Services and Links

The Website may contain links to or integrations with third-party services, including payment gateways, logistics providers, social platforms and analytics tools. Those services are governed by their own terms and privacy practices. Luxenoir is not responsible for third-party websites or services except to the extent required by applicable law.

1.11 Limitation of Liability

To the maximum extent permitted by applicable law, Luxenoir will not be liable for indirect, incidental, special or consequential losses arising from use of the Website or purchase of products. Nothing in these Terms excludes or limits liability, warranties, guarantees, remedies or consumer rights that cannot lawfully be excluded or limited.

1.12 Indemnity

To the extent permitted by law, you agree to indemnify Luxenoir against losses, claims or expenses arising from your unlawful use of the Website, fraud, misuse of services, infringement of third-party rights, or material breach of these Terms.

1.13 Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer-protection law and any mandatory jurisdiction available to consumers, disputes shall be subject to the competent courts at India.

1.14 Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, Website, legal requirements or payment/logistics processes. The updated version will be posted on this page with a revised effective date. Changes will apply prospectively to the extent required by law.
